The July 31st deadline for filing your Income Tax Return (ITR) for Assessment Year 2026-27 has officially passed. If you are a salaried professional juggling office deadlines, endless meetings, and personal commitments, missing the tax deadline can happen to the best of us.
Take a deep breath—you are not locked out of the system. The Income Tax Department provides a window to file a Belated Return under Section 139(4) of the Income Tax Act.
Here is a detailed, easy-to-understand guide on what a belated return means for you, the costs involved, and how to get back on track.
Simply put, if you miss the original July 31st deadline, any return you file after that date is classified as a "belated return". For the current assessment year (AY 2026-27), the absolute last day to file this belated return is December 31, 2026.
While the process of filing remains largely the same as a regular ITR, the delay comes with a few financial consequences.
Filing late means you will have to deal with penalties, interest, and the loss of certain tax advantages. Here is exactly what you need to know:
The most immediate impact is a flat penalty fee, which depends on your total taxable income:
Total Taxable Income and Applicable Penalty
Up to the basic exemption limit (₹3 Lakh) - No Penalty
Between ₹3 Lakh and ₹5 Lakh - ₹1,000
Above ₹5 Lakh - ₹5,000
Note: Even if all your taxes are fully paid via TDS by your employer, you must still pay this penalty to successfully file your return.
If you have any outstanding tax liability—meaning your TDS did not cover your total tax bill—the government will charge simple interest of 1% per month (or part of a month) on the unpaid amount. This calculation starts from the original due date until the day you actually file and pay.
This is a critical update for salaried employees: if you miss the original deadline and file a belated return, you lose the option to opt for the Old Tax Regime. You will be forced to file under the New Tax Regime. This means you cannot claim popular deductions like Section 80C (PPF, ELSS, life insurance), Section 80D (health insurance), or House Rent Allowance (HRA).
If you dabble in the stock market or have a side business, filing late means you cannot carry forward capital losses or business losses to offset future gains. The only exception is loss from house property (such as home loan interest), which can still be carried forward.

Gather Your Documents: Keep your Form 16, bank statements, and investment proofs ready. Log in to the income tax portal and download your Annual Information Statement (AIS) and Form 26AS to cross-check all reported income and TDS.
Re-calculate Your Tax Liability: Re-evaluate your taxes strictly under the rules of the New Tax Regime, since the old regime is no longer available to you.
Pay the Outstanding Dues: If you owe any tax, calculate the 1% per month interest (Section 234A) and the applicable late filing fee (Section 234F). Pay this via a challan on the e-filing portal before submitting your return.
File Under Section 139(4): When you begin your filing process online, ensure you select "139(4) - Belated Return" in the drop-down menu.
E-Verify Immediately: Your ITR is not complete until it is verified. Ensure you e-verify using an Aadhaar OTP or net banking within 30 days of submission to prevent your return from being treated as invalid.
While you technically have until December 31, 2026, to file your belated return, waiting longer will only increase your interest burden under Section 234A and significantly delay any tax refunds you might be owed. Furthermore, failing to file altogether creates a digital gap in your records, which can lead to scrutiny notices and more severe legal consequences.
